1. Acceptance of Terms

By accessing or using any services provided by Harmony Hub Studios, including but not limited to recording, mixing, mastering, podcast production, and any related services (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and Harmony Hub Studios, located at 5400 Hollywood Boulevard, Los Angeles, CA 90028.

2. Services Provided

Harmony Hub Studios offers professional audio recording, mixing, mastering, and podcast production services. We strive to provide high-quality services that meet your artistic and technical requirements. Specific details of the services, including scope, deliverables, and timelines, will be outlined in a separate service agreement or proposal.

3. Booking and Payment

All bookings are subject to availability and require a deposit to secure your session. The deposit amount will be specified at the time of booking. The remaining balance is due upon completion of the services, unless otherwise agreed in writing. We accept payments via credit card, debit card, and bank transfer. Late payments may be subject to interest charges.

4. Cancellation and Rescheduling

Cancellations made within 48 hours of the scheduled session will result in forfeiture of the deposit. Rescheduling is subject to availability and must be requested at least 72 hours prior to the session. Harmony Hub Studios reserves the right to cancel or reschedule sessions due to unforeseen circumstances, in which case a full refund of the deposit will be provided.

5. Intellectual Property

You retain all rights to your original audio recordings and intellectual property. However, you grant Harmony Hub Studios a limited license to use your recordings for promotional purposes, including showcasing our work on our website and social media channels. This license is revocable upon written notice. All rights to the audio files created by Harmony Hub Studios, including mixes and masters, remain the property of Harmony Hub Studios until full payment is received.

6. Confidentiality

Harmony Hub Studios is committed to maintaining the confidentiality of your audio recordings and project details. We will not disclose any confidential information to third parties without your prior written consent, unless required by law.

7. Limitation of Liability

Harmony Hub Studios is not liable for any indirect, incidental, or consequential damages arising out of or in connection with the use of our services, including but not limited to loss of profits, loss of data, or business interruption. Our liability is limited to the amount paid for the specific services provided.

8. Studio Usage

Clients are expected to treat the studio equipment and facilities with respect. Any damage caused by clients will be their responsibility, and they will be liable for repair or replacement costs. No food or drinks are allowed near the recording equipment. Smoking is strictly prohibited inside the studio premises.

9. Client Responsibilities

• Arrive on time for scheduled sessions.
• Provide clear and concise instructions to the engineers.
• Ensure that all necessary permissions and licenses are obtained for any copyrighted material used in your recordings.
• Back up your audio files after receiving the final deliverables. Harmony Hub Studios is not responsible for lost or corrupted files after the project is completed.

10. Termination

Harmony Hub Studios reserves the right to terminate the service agreement if you violate any of these Terms and Conditions. In the event of termination, any remaining balance will be due immediately, and you will forfeit any deposits paid.

11. Amendments

Harmony Hub Studios may amend these Terms and Conditions at any time by posting the revised terms on our website. Your continued use of our services after the posting of revised terms constitutes your acceptance of the changes.

12. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms will be resolved in the state or federal courts located in Los Angeles County, California.

14. Indemnification

You agree to indemnify, defend, and hold harmless Harmony Hub Studios, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms and Conditions or any activity related to your use of our services, including, but not limited to, infringement of intellectual property rights or any negligent or wrongful conduct.

15. Warranties and Disclaimers

Harmony Hub Studios warrants that it will perform the Services in a professional and workmanlike manner in accordance with industry standards. However, Harmony Hub Studios makes no other warranties, express or implied, regarding the Services, including any implied warranties of merchantability or fitness for a particular purpose. Harmony Hub Studios does not warrant that the Services will be error-free or uninterrupted.

You acknowledge and agree that the use of our Services is at your sole risk. Harmony Hub Studios shall not be liable for any delays, errors, or omissions in the provision of the Services that are beyond our reasonable control.

16. Data Retention

Harmony Hub Studios may retain your audio recordings and project files for a period of six months after the completion of the Services, unless otherwise agreed in writing. After this period, Harmony Hub Studios reserves the right to delete or archive your files. It is your responsibility to ensure that you have a backup of your files.

17. Force Majeure

Harmony Hub Studios shall not be liable for any failure to perform our obligations under these Terms and Conditions due to causes beyond our reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargoes, strikes, natural disasters, or governmental actions.

18. Severability

If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. The invalid or unenforceable provision shall be replaced with a valid and enforceable provision that comes closest to expressing the intention of the original provision.

19. Entire Agreement

These Terms and Conditions constitute the entire agreement between you and Harmony Hub Studios regarding the use of our Services and supersede all prior or contemporaneous communications and proposals, whether oral or written.
